Terms and Conditions

Before you begin using the online store www.studiobobbin.pl, customers are obliged to read these Terms & Conditions.

The seller and owner of the store studiobobbin.pl is Joanna Frydel‑Solarska, operating as Joanna Frydel‑Solarska Studio Bobbin, with its registered office in Cieszyn (43‑400) at ul. Kresowa 9a, Tax ID (NIP): 5481327905, REGON: 541848843, registered in the Central Register and Information on Economic Activity (CEIDG), maintained by the minister responsible for economic affairs.

§ 1. DEFINITIONS

Store – the online service run by the Seller, accessible at the address: studiobobbin.pl.

Seller – the enterprise Joanna Frydel‑Solarska Studio Bobbin, with its seat in Cieszyn (43‑400), at ul. Kresowa 9a, having NIP: 5481327905 and REGON: 541848843, entered into the CEIDG (Central Register of Economic Activity).

Customer – an adult natural person or a company that places an order via the Store.

Terms & Conditions (Regulations) – this document specifying the rules of using the Store.

Product – a physical good available for purchase in the Store.

Registration – the one‑time procedure by which a Customer creates a user account through the panel on the Store’s website.

Order – a Customer’s declaration of intent to conclude a distance sales agreement, specifying among other things the type and quantity of the chosen Products.

Order Form – the form made available in the Store that enables submitting an Order, in particular by adding products to the cart and selecting delivery and payment options.

Order Fulfilment Time – the period during which the Seller prepares the Order and hands it over to the carrier; this does not include delivery time (i.e. the period from when the shipment is handed to the carrier until it is delivered to the Customer).

Business Day – any day Monday through Friday, excluding statutory public holidays.

§ 2. GENERAL PROVISIONS

These Terms & Conditions define the rules for concluding and executing sales agreements for Products offered in the Store, as well as regulate the manner of use of the Store.

The Customer may contact the Store via email (studiobobbinpl@gmail.com), via the contact form available on the Store’s site, or by postal mail.

To use the Store, the Customer should have a device with Internet access and a web browser (Internet Explorer, Chrome, Firefox, Opera, Safari) in a current version, with JavaScript and cookies enabled. An active email address is also required.

All products offered in the Store are brand new, free from defects, and legally admitted for sale in Poland.

The data controller for personal data processed in connection with using the Store is the Seller. These data are processed in accordance with the purposes, legal bases, and principles set forth in the privacy policy available on the Store’s website. That document contains, among other things, information on data processing, the rights of data subjects, and the use of cookies and analytics tools. Use of the Store, including making purchases, is entirely voluntary, as is providing personal data—unless the privacy policy states otherwise.

Using the Store requires prior reading and full acceptance of these Terms & Conditions.

§ 3. PLACING AND EXECUTION OF ORDERS

The Customer may purchase products offered in the Store by placing an order. Orders can be placed 24/7 via:
a. the online Store through the Order Form (www.studiobobbin.pl),
b. sending an email to: studiobobbinpl@gmail.com
.

The Store begins processing orders Monday through Friday, during business hours from 9:00 to 17:00. Orders placed after 17:00 on business days, and on Saturdays, Sundays or public holidays, will be processed on the next business day.

To place an order, it is necessary to correctly fill in all required fields in the form, including first name, last name, delivery address, email address, and phone number. Incorrect or incomplete data may lead to the cancellation of the order by the Store.

Until the moment the “Buy & Pay” button is clicked, the Customer may freely edit the order and shipping data. Confirming the order by this button constitutes an obligation to pay for the ordered products and cover the shipping costs, which the Customer is informed about beforehand.

The Store confirms acceptance of the order for fulfilment by sending an email to the address provided by the Customer in the form. This confirmation simultaneously constitutes conclusion of the Sales Agreement.

§ 4. PRICES AND PAYMENTS

Prices of products in the Store are quoted in Polish złoty (PLN) and are gross prices (including VAT). Prices do not include delivery costs, which are shown separately.

In the event of price changes, an Order will be fulfilled at the price in force at the time the order was placed.

The Seller reserves the right to:

change product prices,

add new products to the Store’s assortment,

remove products from the offering,

introduce, modify, or withdraw promotions available on the Store’s site.

All changes are made in accordance with the Civil Code and other applicable laws. These changes do not affect the rights of customers who concluded a sales agreement before the changes or those participating in a promotion in accordance with its rules.

Available payment methods:
a. Cash on delivery – payment made upon receipt of goods delivered by the InPost courier.
b. Online payment – instant bank transfer or card payment via PayU S.A. The card payment operator is PayU S.A., headquartered in Poznań (60‑166), at ul. Grunwaldzka 186, KRS 0000274399, NIP 7792308495. Current payment methods are available at https://poland.payu.com.
c. Bank transfer – direct deposit to the Seller’s bank account:

If prepayment is selected, failure to credit the payment within 3 days from placing the order will result in order cancellation.

Essential terms of the distance sales contract are recorded and provided to the Customer as proof of purchase—electronically or in paper form—along with delivery of the Order.

§ 5. SHIPPING OF PRODUCTS

Products are delivered within the Republic of Poland to the address indicated by the Customer in the order form.

If the prepayment option is chosen, order fulfilment begins upon crediting of funds (including delivery costs) in the Store’s bank account. If cash on delivery is chosen, fulfilment starts after the sales agreement is concluded, per § 3 sec. 5.

Orders are processed only on business days. Orders placed on Saturdays, Sundays or public holidays are handled on the next business day. The fulfilment time indicated for a specific product is counted from the moment funds are credited or from the conclusion of the sales agreement (for cash on delivery).

The delivery time includes the order fulfilment time, which depends, among other things, on the moment of funding (usually up to 2 business days), and the estimated delivery time.

Products are delivered to the address indicated by the Customer within Poland via InPost courier or InPost parcel lockers, depending on the chosen delivery method.

Shipping costs are shown during order placement and are available on the Store’s website.

Estimated delivery time is 2 to 3 business days.

The Customer is obliged to inspect the shipment upon receipt. In case of damage or missing items due to transport, the Customer should take necessary steps to establish the liability of the carrier.

§ 6. RETURNS — WITHDRAWAL FROM THE CONTRACT

The Customer has the right to withdraw from the distance sales contract without giving a reason, within 14 days from the day the Products are received or delivered to a third party indicated by the Customer, other than the carrier.

To exercise the right of withdrawal, the Customer must inform the Store of their decision by sending a declaration to the email address studiobobbinpl@gmail.com. After receiving such a declaration, the Store will promptly confirm its acceptance.

Products intended for return must be sent to: Joanna Frydel‑Solarska Studio Bobbin, ul. Kresowa 9a, 43‑400 Cieszyn, with the note “RETURN,” no later than 14 days from the day the Store is informed about the withdrawal.

The return shipping costs are borne by the Customer.

The Store does not accept cash‑on‑delivery shipments for returns.

Upon withdrawal, the Store will refund all payments received from the Customer, including delivery costs, within 14 days of receiving the returned Products.

The refund will be made via the same payment method used by the Customer unless the Customer agrees to another method.

The Customer is liable for any diminished value of the Products resulting from use beyond what is necessary to ascertain their nature, characteristics, or functioning.

The right of withdrawal does not apply to goods made to the Customer’s specifications or clearly personalized.

§ 7. COMPLAINTS (WARRANTY)

If the product has defects amounting to nonconformity with the contract, the Customer has the right to file a complaint.

Complaints should be submitted by email to studiobobbinpl@gmail.com. The submission should include as much detail as possible about the product defect, date of occurrence, and contact information. This helps expedite the complaint process.

After receipt of acknowledgment, the Customer should send the defective product to: Joanna Frydel‑Solarska Studio Bobbin, ul. Kresowa 9a, 43‑400 Cieszyn, marked “COMPLAINT.”

The Seller does not accept cash‑on‑delivery shipments for complaints.

The Customer will be informed of the decision regarding the complaint within 14 days from the date the Store receives the returned product.

If defects are substantiated, the Customer is entitled to (in accordance with Articles 556 and 561 of the Civil Code):
a) withdraw from the contract or reduce the product price,
b) exchange the product for a defect‑free one or require removal of the defect.

If the complaint is rejected, the product will be returned to the Customer with a written justification of refusal.

§ 8. ELECTRONIC SERVICES INFORMATION

The Store provides the following electronic services to Customers:
a) enabling the conclusion of online sales agreements under these Terms & Conditions; such an agreement is temporary and expires upon placing the Order or the Customer’s withdrawal.
b) enabling customers to create an account in the Store—this agreement is for an indefinite period.
c) sending ordered commercial information about offered Products (newsletter)—an agreement for an indefinite period.

The Customer may withdraw from the sales agreement under applicable law and these Terms & Conditions. Additionally, the Customer may at any time unsubscribe from services in § 1 items b) and c) by sending a request to the Seller—by email to studiobobbinpl@gmail.com or by mail to Joanna Frydel‑Solarska Studio Bobbin, ul. Kresowa 9a, 43‑400 Cieszyn.

The technical requirements necessary to use the Store’s electronic services include:
a) Internet access,
b) a web browser capable of handling hypertext documents (e.g. Internet Explorer, Opera, Firefox, or similar),
c) an active email account.

Complaints related to electronic services provided by the Store can be submitted by email to studiobobbinpl@gmail.com. The complaint should identify the Customer and briefly describe the issue. The Store will make every effort to resolve complaints promptly, but no later than 14 days from receipt. The resolution will be communicated to the Customer’s email.

§ 9. INTELLECTUAL PROPERTY

All materials available in the Store, such as texts, graphics, product photos, layout, trademarks and other elements, are protected by law and constitute property subject to exclusive rights, particularly copyrights and industrial property rights.

Use of any elements contained on the website www.studiobobbin.com without prior written consent of the Seller is illegal, constitutes infringement of the Seller’s proprietary rights and may result in civil and criminal liability.

§ 10. FINAL PROVISIONS

Polish law applies to sales agreements concluded via the Store. Contracts are concluded in the Polish language.

Where not regulated in these Terms & Conditions, the relevant provisions of the Civil Code and other applicable statutory acts governing business operations apply.

Any disputes shall be resolved by the court having jurisdiction under applicable law.

The Customer may avail themselves of out‑of‑court methods of handling complaints and claims. For amicable dispute resolution related to online purchases, the Customer may submit a complaint via the EU ODR platform, available at: http://ec.europa.eu/consumers/odr/

The Seller reserves the right to introduce changes to the Terms & Conditions at any time. Changes will apply to orders placed after their entry into force, with due regard to paragraph 2 above.
